Terms and Conditions for the Horse of the Year Show website, services, products and competitions

  • These are the Terms and Conditions for Grandstand Media Limited and Grandstand Event Management for the range of products and services we provide through this website and additional applications in the context of Horse of the Year Show (HOYS) “our site”.

In these Terms & Conditions:

The terms “you”, “your” and “yours” means any user of our website, enquirer or any person submitting any data to us or this Site about himself or herself or about any other living individual in respect of any use of the Site.

The term “personal data” refers to personally identifiable information about you or any other living individual in respect of any use of this Site.

The term “Horse of the Year Show”, (“HOYS”), means the show under that name/s which we run annually.

Site Terms of Use (“Site Terms”)

Access to this Site and Changes

  1. Access to and use of the www.hoys.co.uk website (“this Site”) is provided by us subject to these Site Terms. “We” are Grandstand Media Ltd, a company registered in England under number 2889798 with registered office at Stoneleigh Park, Kenilworth, Warwickshire, CV8 2LZ.
  2. Your use of any part of this Site constitutes your acceptance of these Site Terms which takes effect on the date on which you first use this Site. If you do not agree with these Site Terms, you should cease using this Site immediately.
  3. We reserve the right to change these Site Terms at any time without notice to you by posting changes online. You are responsible for regularly reviewing information posted online to obtain timely notice of such changes. Your continued use of this Site after changes are posted constitutes your acceptance of the amended Site Terms.
  4. We may also include additional rules and requirements for using parts of this Site (for example competition rules). You are responsible for reviewing all information on this Site in relation to your particular use of this Site and complying with any applicable rules or requirements.
  5. You are responsible for bringing these Site Terms to the attention of all persons accessing this Site through your Internet connection.
  6. You must not interfere with another person’s use of this Site or otherwise act in a way that negatively affects another person’s use of this Site.
  7. You are responsible for checking the contents of this Site and restricting its access to minors under your control.
  8. You shall not use this Site or upload any material to this site in any way which in any respect:
  9. a) Is in breach of any law, statute, regulation, byelaw or code of practice of any applicable jurisdiction;
    b) Is fraudulent, criminal or unlawful;
    c) Is inaccurate or out-of-date;
    d) May be obscene, indecent, pornographic, vulgar, profane, racist, sexist, discriminatory, offensive, derogatory, harmful, harassing, threatening, embarrassing, malicious, abusive, hateful, menacing, defamatory, untrue or political;
    e) Impersonates any other person or body or misrepresents a relationship with any person or body;
    f) May infringe or breach the copyright or any intellectual property rights or privacy or other rights of us or any third party;
    g) May be contrary to our interests;
    h) Is contrary to any specific rule or requirement that we stipulate on this Site in relation to a particular part of this Site or this Site generally; or
    i) Involves your use, delivery or transmission of any viruses, unsolicited e-mails, trojan horses, trap doors, back doors, easter eggs, worms, time bombs, cancelbots or computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information.
  10. You hereby grant to us an irrevocable, royalty-free, worldwide, assignable, sub-licensable licence to use any material which you submit to us or this Site for the purpose of use on this Site or for generally marketing (by any means and in any media) this Site or the British Showjumping National Championships or our products or services generally. You agree that you waive your moral rights to be identified as the author and we may modify your submission.
  11. We do not undertake to monitor any comments made by users on this Site, but we reserve the right in our absolute discretion to omit, remove, suspend or edit any material, information or data that you or any user transmits, posts or sends to us or this Site.
  12. The views and comments on contributions to this Site are those of the authors and do not necessarily reflect the views of us or any of our officers or employees. We will not be responsible or liable for any material, information or data supplied by you or other users to this Site.
  13. You agree to comply at all times with any instructions for use of this Site which we make from time to time.
  14. You shall fully and promptly indemnify us against all damages, proceedings, claims, demands, liabilities, losses, charges, costs and expenses which we may suffer or incur as a result (direct or indirect) of any breach by you of any obligation on you under these Site Terms.

Availability of ‘our’ Site, Security and Accuracy

  1. Whilst we endeavour to make this Site available 24 hours a day, we will not be liable if for any reason this Site is unavailable at any time or for any period. We make no warranty that your access to this Site will be uninterrupted, timely or error-free. Due to the nature of the Internet, this cannot be guaranteed. In addition, we may occasionally need to carry out repairs, maintenance or introduce new facilities and functions.
  2. Access to this Site may be suspended or withdrawn to or from you personally or all users temporarily or permanently at any time and without notice. We may also impose restrictions on the length and manner of usage of any part of this Site for any reason. If we impose restrictions on you personally, you must not attempt to use this Site under any other name or user.
  3. We do not warrant that this Site will be compatible with all hardware and software which you may use. Although we may put in place security measures for your protection, we shall not be liable for damage to, or viruses or other code that may affect, any computer equipment, software, data or other property as a result of your access to or use of this Site or your obtaining any material from, or as a result of using, this Site. We shall also not be liable for the actions of third parties in breaching any security measures.
  4. We may change or update this Site and anything described in it without notice to you.
  5. Whilst we endeavour to ensure that information and materials on this Site (including without limitation details about our products and services) are correct, no warranty, express or implied, is given that they are complete, accurate or up-to-date and we do not accept any liability for any errors or omissions. If you place orders through or as a result of using this Site, you are responsible for ensuring that your orders contain all necessary and accurate information.
  6. The contents of this Site are intended for convenience only. Nothing on this Site shall constitute advice specific to your circumstances or a recommendation. We do not suggest that any product or service mentioned on this Site is either available to you or complies with laws outside of England and Wales.

Supply of products or services on this Site:

  1. Our supplies of our products and services referred to on this Site shall be governed by our terms and conditions applicable to the sale or supply of those products and services. A copy of our terms and conditions are on this Site or available to you upon request by contacting us by e-mail, telephone, fax or post at the contact details set out at the end of these Site Terms.
  2. Any supplies of products or services by any third parties referred to on this Site (for example, the ticket office or sellers of property) shall be governed by those third parties’ own terms and conditions applicable to the sale or supply of those products and services. We are not responsible for the acts or omissions of any third parties and it is your responsibility to deal directly with the third party from whom you buy products or services in the event of you having any claims or issues. 

Our liability to you

  1. We do not exclude or limit our liability for death or personal injury caused by our negligence or for our fraudulent misrepresentation.
  2. To the extent possible by law, in all cases other than in respect of products or services that we supply for a fee, to the extent permitted by law we shall not be liable for any direct or consequential losses (including, without limitation, loss of business, loss of data, loss of use, business interruption and loss of profits) arising from the use of or inability to use this site, or any material contained in it or accessible from it, or from any action or decision taken as a result of using this site or any such material.

 

Trademarks

  1. The Grandstand Media Ltd names and logos [Horse of the Year Show and British Showjumping National Championships] and all other brands, names, logos, marks and slogans on this Site are the trademarks or service marks of us, our event partners or our licensors. 

Third Party Websites, Pages and Content

  1. This Site may contain links to other websites (for example, those of the ticket office, sponsors or marketing partners). Although we have sought to carefully select any site to which a link from this Site exists, we have no control over and accept no responsibility for the content of such linked sites. The links are provided “as is” with no warranty, express or implied, for the information provided within such sites.
  2. This Site may also contain content and/or dedicated pages provided by third parties (for example trade stand holders’ and advertisers). Although we have sought to carefully select any third party providing those pages, we have no control over and accept no responsibility for the content of such pages, which is uploaded directly by those third parties. Those dedicated pages are the responsibility of the people providing those pages. We make no warranty, express or implied, for the information provided within those pages.
  3. In addition, this Site may contain advertising content provided by third parties. We have no control over and accept no responsibility for that content. Those adverts are the responsibility of the advertisers. We make no warranty, express or implied, for the information or content within those adverts.
  4. You must not without our permission frame any of this Site onto your own or another person’s website.
  5. We hereby grant to you a revocable, non-exclusive, royalty-free right to provide a link from your website to the home page of this Site, provided that you do so in a fair and legal way without damaging our reputation or taking advantage of it. In particular:

  2. You must at all times keep your user name and password strictly confidential and secure.
  3. You must not choose a password which can be readily guessed.
  4. You must not disclose or allow others to have access to your user names or passwords without our prior permission, unless you are the authorised user or the authorised employee acting on behalf of the authorised user.
  5. If you think you may have lost or allowed a third party to see or use your user names or passwords, you must inform us immediately.
  6. You shall be responsible for all use of this Site made under your user names.
  7. We may require that your user names or passwords are changed from time to time.

Copyright notice and Privacy Policy

  1. You agree to be bound by the Copyright Notice and Privacy Policy currently in force. 

Severability

  1. If any of these terms should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction which that term is illegal, invalid or unenforceable, it shall be severed and deleted and the remaining Site Terms shall survive, remain in full force and effect and continue to be binding and enforceable.

Other uses of your personal information

  1. We may also send you or the people you represent other information about us, the Site, our other websites, our products, sales promotions, our services, our further events, our newsletters, anything relating to other companies in our group or our business partners related to our events or anything in which you or your party show an interest. If you would prefer not to receive any of this additional information as detailed in this paragraph (or any part of it) please send us an appropriate e-mail to webmaster@hoys.co.uk or write to us at the above address specifying which information you do not wish to receive. Within 7 working days of receipt of your instruction we will cease to send you information as requested. If your instruction is unclear we will cease to send you all information referred to in this paragraph.

Third Party Links, Pages and Content

  1. We may pass your details to other companies in our group. We may also pass your details to our agents and subcontractors to help us with any of our uses of your data set out in our Privacy Policy. For example, we may use third parties to assist us with providing the administration for running Horse of the Year Show, to enable us to collect payments from you, to analyse data and to provide us with marketing or customer service assistance.
    We may exchange information with third parties for the purposes of fraud protection and credit risk reduction.
  2. We may transfer our databases containing your personal information if we sell our business or part of it.
  3. We may also disclose your details as described in the Privacy Policy. Other than as set out in the Privacy Policy, we shall NOT sell or disclose your personal data to third parties without obtaining your prior consent unless this is necessary for the purposes set out in the Privacy Policy or unless we are required to do so by law.
    The Site may contain advertising of third parties, dedicated pages operated by third parties and links to other sites or frames of other sites. Please be aware that we are not responsible for the privacy practices or content of those third parties or other sites, nor for any third party to whom we transfer your data in accordance with our Privacy Policy.

Security

  1. We have in place appropriate technical and security measures to prevent unauthorised or unlawful access to or accidental loss of or destruction or damage to your information.
    We store your personal details on a secure server. We use firewalls on our servers.
    We reveal only the last four digits of your credit or debit card numbers when confirming an order to you, but of course we transmit the entire card number to the appropriate card company for collecting payment.
  2. We maintain physical, electronic and procedural safeguards in connection with the collection, storage and disclosure of your information. Our security procedures mean that we may occasionally request proof of identity before we disclose personal information to you.
  3. You are responsible for protecting against unauthorised access to your password and to your computer.

Cookies

  1. The Site uses cookies. Cookies are files which identify your computer to the server of websites as a unique user and they are stored by your Internet browser on your computer’s hard drive. Please see Privacy Policy for further information on the use of our Cookies.

Changes

  1. Any material changes to the way in which we use your data will be described in future versions of the Privacy Policy. Each time you enter the Site, change your data, take part in a discussion forum, order services or products or ringtones from or through us, obtain material from us, upload material onto the Site or advertise, you agree that the Privacy Policy current at that time shall apply to all information which we hold about you.

Consent

  1. By submitting data to us and using the Site, you consent to our use of your data and anyone who you represent in the manner set out in the Privacy Policy (as amended) and you are responsible for ensuring that you have authority to consent on their behalf.

English law and jurisdiction

  1. These Site Terms shall be governed by and construed in accordance with English law. You submit to the jurisdiction of the English courts. You irrevocably agree that the English courts shall have exclusive jurisdiction over any claim or matter brought by you in relation to these Site Terms. We shall also have the right to bring a claim against you in the jurisdiction in which you are based and any other court of competent jurisdiction.

Terms and Conditions regarding all ticket, package and hotel purchases

Cancellation policy

  1. Ticket bookings (including General Tickets, Hospitality Tickets, Season Tickets and Champions Bar Tickets) are not refundable unless the event, “Horse of the Year Show”, is cancelled or rescheduled. Should the event be cancelled or rescheduled you will be entitled to a refund of your Ticket Price (does not include administration, cancellation, service and venue facility fees). You therefore need to check the details of the performance you plan to attend before booking and let us know upon receipt of the booking confirmation of any error.
  2. Ticket package bookings (including Mountain and Moorland Spectacular Package) are not refundable unless the event, “Horse of the Year Show”, is cancelled or rescheduled. Should the event be cancelled or rescheduled you will be entitled to a refund of your Ticket Price (does not include administration, cancellation, service and venue facility fees). You therefore need to check the details of the performance you plan to attend before booking and let us know upon receipt of the booking confirmation of any error.
  3. Hotel bookings are not refundable. You therefore need to check the details of the booking carefully prior to ordering and let us know upon receipt of the booking confirmation of any error.

 

Terms and conditions for purchasing tickets

  1. Grandstand Media Ltd is not liable for lost, destroyed or stolen tickets and cannot guarantee to replace them. This applies to all tickets and accreditation: General Tickets, Sponsors Badges, Hospitality Tickets, Season Tickets, M&M Tickets, Champions Bar Tickets, wristlets and special packages.
  2. All accreditation, including season ticket badges, are for exclusive use of one person. Tickets are not transferable and their resale for profit or commercial gain (except by us or our authorised sub-agents) or use in promotions or packages without the express permission of the organiser is prohibited and may render them void.
  3. Please check details such as timings and car park charges with the venue before travelling, as these may be subject to late changes.
  4. You must produce a valid ticket to attend the event and removing parts of, defacing or otherwise altering your ticket may render it void.
  5. If you experience any problems with your seating or enjoyment prior to, or during, the event, please inform Grandstand Media Ltd staff immediately as issues cannot always be resolved after the event.
  6. The use of cameras, video or sound recording equipment is strictly prohibited without express permission in writing by Grandstand Media Ltd and any unauthorised use of such items may be confiscated.
  7. By attending the event you consent to being filmed / recorded as part of the audience for security and broadcast, without payment.

  9. Payment for all purchases must be by credit or debit card. We accept payment with Visa, Mastercard and Maestro debit & credit cards. We do not accept American Express cards. 

Hospitality

  1. You may change performances subject to availability and paying in advance the balance if applicable.
  2. Grandstand Media Ltd reserve the right to refuse admission to Horse of the Year Show to any person or to withdraw permission at any time to remain on the grounds and shall not be required to give any reason for such action.
  3. The allocation of seating in the hospitality area is made strictly at Grandstand Media Ltd’s discretion, however requests are accepted and will be applied when possible.

 

Terms and conditions for purchasing Hotel Rooms

  1. Given the nature of this booking there is no right of cancellation (information, cancellation and additional charges) under the regulations 2013. However, it may be possible to amend the booking at the discretion of Grandstand Media Ltd. We would recommend that you consider taking insurance to cover the purchase and any unforeseen cancellation eventualities. If you wish to modify your booking, please contact the Grandstand Media Ltd Commercial Department on 02476 858 205.
  2. All hotel rates are sold on a Bed and Breakfast basis; therefore, breakfast is included with all bookings.
  3. Check in and check out times are specific to the hotel and specified on the confirmation for the booking and are also available at www.hoys.co.uk/hotels.
  4. Parking is not included with this booking unless otherwise stated. Where available parking may be arranged directly with the hotel but is not guaranteed.
  5. On departure, guests must vacate their rooms and check out no later than the time specified for the specific hotel. Failure to do so will entitle the hotel to charge for an additional night at their standard rate.
  6. Price lists for additional items, such as restaurant meals and room service, are provided by the hotel.  All guests are liable for any room services, no additions are included as part of the bed & breakfast rate.  All guest bills must be settled on check out.
  7. In the event of non-arrival for the stay, no refunds will be applicable and 100% of the cost still applies.
  8. The hotel reserves the right to refuse a guest entry and accommodation if, on arrival, management reasonably considers that the guest is under the influence of drink or drugs, is unsuitably dressed or is behaving in a threatening, abusive or otherwise unacceptable manner.
  9. The hotel reserves the right to require a guest to leave if he/she is causing a disturbance, annoying other guests or hotel staff or is behaving in an unacceptable manner.
  10. Guests shall not carry out any electrical or other works at the hotel, including installation and lighting.
  11. Guests shall not bring any dangerous or hazardous items into the hotel and must remove any items promptly when requested by the hotel.  In addition, guests shall not affix any material to any kind of floors, walls or ceilings.
  12. Guests shall comply with all reasonable rules and procedures in effect at the hotel, including but not limited to health and safety and security procedures and statutory requirements as to registration.
  13. Guests shall not bring their own food or drink into the hotel for consumption at the hotel.
  14. Children under the age of 18 must always be supervised by an adult guest.
  15. Pets/animals are not permitted into the hotel unless otherwise stated. For the Hilton Birmingham Metropole domestic pets may be kept in the guest’s room (but are not allowed in other areas) provided they are kept strictly under control and provided that they are clean, free from disease and not dangerous.
  16. Whilst all reasonable efforts have been taken by Grandstand Media Ltd to ensure that Bookings made under this Agreement are able to proceed, Grandstand Media Ltd reserve the right to relocate any Booking to another hotel of similar size and standard in the locality. In making this booking you acknowledge that we, and the hotel, accept no liability for any loss or damage suffered by or caused to you in consequence of your relocation.
  17. We shall not be liable for any failure or delay by the hotel in performing any of its obligations under this Agreement including (without limitation) war or threat of war, civil or political action or disturbance, riot, natural disaster, fire, epidemic, bad weather, terrorist activity (threatened or actual), military activity, governmental or regulatory action, industrial dispute, act of God, failure of power or machinery, failure of or interruption in externally provided services and utilities, and all similar events outside the hotel’s control.
  18. Guests will be liable for any loss, damage or personal injury they may cause at the hotel.
  19. Additional folding beds (z-beds) are only suitable for children aged 12 years and under.

 

Grandstand Media Ltd Online Ordering Terms and Conditions

  1. These Online Ordering Terms and Conditions govern the online submission of an order form (“Order Form”) to us for hotels, hospitality, advertising or other services or products detailed on the Order Form (“Services”) through the www.hoys.co.uk website (“the Site”) by a visitor to the website (“you”). “We” are Grandstand Media Ltd, a company registered in England under number 2889798 with registered office at Stoneleigh Park, Kenilworth, Warwickshire, CV8 2LZ. To the extent that there is any inconsistency between these Online Ordering Terms and Conditions and any other terms and conditions applicable to your Order Form, the provisions of these Online Ordering Terms and Conditions shall prevail. By agreeing to submit your Order Form, you agree to be legally bound by these Online Ordering Terms and Conditions.
  2. When submitting an Order Form to us on the Site, you must follow the instructions on the Site as to how to make and amend the Order Form before you submit it to us.
  3. Just before you submit your Order Form, you will be informed of the price you must pay including VAT, if applicable. Subject to clause 12 below, this is the total that you will pay for the items stipulated in the Order Form.
  4. When you submit your Order Form through the Site, you shall pay for the items stipulated in the Order Form at the time of submitting your Order Form by supplying us with your payment card details from a payment card company acceptable to us, which we require in order to process your Order Form. We may obtain the money for payment before we have accepted your Order Form in accordance with clause 10 below. We shall not be bound to agree to your Order Form until the later of our acceptance under clause 10 below and our receipt of cleared funds in full from you.
  5. You undertake that: (a) you are aged 18 or over; (b) all details you provide to us during submission of your Order Form are correct; (c) you have the full right to use the payment card used; and (d) there are sufficient funds or credit facilities to cover the cost of payment in full. We reserve the right to obtain validation of the payment card details before accepting your Order Form.
  6. When you submit your Order Form, you agree to do so subject to these Online Ordering Terms and Conditions, together with the Site Terms of Use and Privacy Policy in force at the time of your submission.
  7. Your submission of your Order Form remains valid as an offer until when we accept it or if earlier when we have become aware that you are withdrawing your offer contained in your Order Form before we have accepted it.
  8. Following receipt of your Order Form, we may send to you a summary email, letter or other communication in writing as an acknowledgement of receipt of your Order Form. An acknowledgement of your Order Form by us does not constitute our acceptance of your Order Form unless your Order Form is expressly accepted in accordance with clause 10 below.
  9. We may in our absolute discretion refuse to accept any Order Form for any reason. If we refuse to accept your Order Form (or you withdraw your Order Form before we have accepted it under clause 10 below) after we have obtained payment from you in circumstances where we reasonably consider that you may have abused our process or you had no legitimate or reasonable right to submit your Order Form, we may deduct a reasonable fee to cover our charges and costs involved in processing your Order Form and return any balance to your payment card company. In all other circumstances where we refuse to accept your Order Form (or you withdraw your offer in your Order Form before we have accepted it under clause 10 below), we shall return to your payment card company in full the money that your payment card company paid to us.
  10. We shall be deemed to have accepted your Order Form when we dispatch an email, letter or other communication in writing that expressly states that we are accepting your Order Form. Unless expressly stating that we accept your Order Form, any other email, letter or other communication in writing from us is purely for information purposes only and does not constitute our acceptance of your Order Form.
  11. If you discover you have made a mistake with your order after you have submitted it to us, you must contact us at webmaster@hoys.co.uk immediately.
  12. We will endeavour to ensure that all prices given to you before you submit your Order Form are accurate, but the prices will need to be validated by us before acceptance. If the price for the items covered by your Order Form changes before we have accepted it, we will contact you and ask you to confirm that you wish to proceed at the amended price. If you do not agree to proceed at the amended price, then you may withdraw your Order Form by informing us at any time before our acceptance in accordance with clause 10 and we shall return to your payment card company in full any money that your payment card company paid to us. We shall be deemed to have received that information only when a living person acting on our behalf has actual knowledge of your withdrawal.
  13. We shall keep a record of your Order Form, these Online Ordering Terms and Conditions and all other applicable terms and conditions relevant to the Services you ordered until six years after we have accepted your Order Form. However, for your future reference, you are advised to print and keep a copy of your Order Form, these Online Ordering Terms and Conditions and all applicable terms and conditions.
  14. We shall not be liable for any delay, hindrance to us or failure to deliver or provide the Services due to any circumstances outside our reasonable control including but not limited to Acts of God, actions of third parties (including hackers, suppliers, governments or supra-national authorities), war, hostilities, warlike operations, riot, civil commotion, insurrection, national emergencies, terrorism, piracy, arrests, restraints or detainments of any competent authority, strikes or combinations or lock-out of workmen, epidemic, fire, explosion, storm, flood, drought, earthquake, natural disaster, accident, mechanical breakdown, failure or problems with public utility supplies (including without limitation electrical, telecoms or general Internet failure), shortage of or inability to obtain materials, supplies, equipment, accommodation, transportation or people.
  15. No failure or delay by either you or us in exercising any right shall operate as a waiver of such right or extend to or affect any other or subsequent event or impair any rights or remedies in respect of it or in any way modify or diminish your or our rights.
  16. If any provision in these Online Ordering Terms and Conditions shall become or shall be declared by any court of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall in no way affect any other provision, all of which shall remain in full force and effect, so long as the Online Ordering Terms and Conditions shall be capable of continuing in effect without the unenforceable provision.
  17. We have endeavoured to ensure that our supply of the Services complies with English laws. However, we make no representations and give no warranties that the Services are appropriate or available for use by people in locations outside of the United Kingdom. Anyone who orders Services from the Site does so on their own initiative and is responsible for compliance with all applicable laws. If ordering Services from the Site is contrary to or infringes any applicable law in your jurisdiction, you should not make the order.
  18. The contract relating to your Order Form shall be governed by and construed in accordance with English law. You submit to the jurisdiction of the English courts. You irrevocably agree that the English courts shall have exclusive jurisdiction over any claim or matter brought by you in relation to that contract. We shall also have the right to bring a claim against you in the jurisdiction in which you are based and any other court of competent jurisdiction. All dealings, correspondence and contacts between us shall be made or conducted in the English language. 

 

Terms & Conditions of Horse of the Year Show (HOYS) Ticket Voucher 

This page (together with the documents referred to on it) tells you the terms and conditions on which we supply any HOYS Ticket Voucher Package (“Package”), which contains a personalised voucher from Horse of the Year Show, containing instructions on how it can be redeemed against general admission tickets only for the 2024 Show, and a three-tier HOYS Christmas rosette with festive greeting embossed on the tail. Detailed on our website www.hoys.co.uk (“our site”) to you. Please read these terms and conditions carefully. You should understand that by ordering any of our Packages, you agree to be bound by these terms and conditions. You should print a copy of these terms and conditions for future reference. By placing your order with us, you accept the “Terms & Conditions of Sale” and you are agreeing to be bound by these terms.

  2. INFORMATION ABOUT US: www.hoys.co.uk is a site operated by Grandstand Media Limited (“we”, “us” or “our”). We are registered in England and Wales under company number 4320393 and with our registered office at Grandstand Media Ltd, Stoneleigh Park, Kenilworth, Warwickshire, CV8 2LZ. Our VAT number is 806 2117 63.
  3. YOUR STATUS: By placing an order for a Package, you warrant that:
    (a) you are legally capable of entering into binding contracts;
    (b) you are a ‘consumer’ (being an individual purchasing the Package outside the course of his or her business or trade)
  4. HOW THE CONTRACT IS FORMED BETWEEN YOU AND US:
    Please note, once you have placed an order with us, we are unable to amend it.
  5. CANCELLATIONS, RETURNS AND REFUNDS:
    No cash refund/exchange is available on HOYS Ticket Voucher Packages. Vouchers can only be redeemed in one transaction. Cash will not be refunded or exchanged.
  6. VOUCHER EXPIRY DATE
    Vouchers must be used by 13th October 2024 after which point, they will expire.
  7. OUR LIABILITY:
    7.1 
    We warrant to you that any Package purchased from us is of satisfactory quality and reasonably fit for all the purposes for which products of the kind are commonly supplied.
    7.2 
    Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the Package you purchased and any losses which are a foreseeable consequence of us breaking the agreement. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us.
    7.3 
    This does not exclude or limit in any way our liability: (a) for death or personal injury caused by our negligence; (b) under section 2(3) of the Consumer Protection Act 1987; (c) for fraud or fraudulent misrepresentation; or (d) for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
    7.4 We are not responsible for indirect losses which happen as a side effect of the main loss or damage and which are not foreseeable by you and us and, including but not limited to: (a) loss of income or revenue; (b) loss of business; (c) loss of profits or contracts; (d) loss of anticipated savings; (e) loss of data; or (f) loss of data, provided that this clause 7.4 shall not prevent claims for loss of or damage to your tangible property that fall within the terms of clause 7.1 or clause 7.2 or any other claims for direct financial loss that are not excluded by any of categories (a) to (f) inclusive of this clause 7.4.
  8. AVAILABILITY AND DELIVERY:

    Orders will not be dispatched from the offices of Horse of the Year Show until Monday 11th December 2023.
    8.2 
    If you provide to us any instructions relating to the delivery of your order (including, without limitation, instructions to leave the Package in a particular place, outhouse or with a neighbour), you are responsible for ensuring the accuracy of these instructions and we shall not be liable to you in relation to any loss of or damage to the Package resulting from our following of your instructions.
  9. RISK AND TITLE:
    9.1 
    The Packages will be at your risk from the time of delivery.
    9.2 
    Ownership of the Packages will only pass to you when we receive full payment of all sums due in respect of the Packages, including delivery charges.
  10. PRICE AND PAYMENT
    10.1 
    The price of any Package will be as quoted on our site from time to time, except in cases of obvious error.
    10.2 
    Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation
    10.3 
    It is always possible that, despite our best efforts, the Packages detailed on our site may be incorrectly priced. We will normally verify prices as part of our dispatch procedures so that, where a Package’s correct price is less than our stated price, we will charge the lower amount when dispatching the Packages to you. If a Package’s correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before dispatching the Package, or reject your order and notify you of such rejection.
    10.4 
    We are under no obligation to provide the Package to you at the incorrect (lower) price, even after we have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing.

    Payment for all Packages must be by credit or debit card. We accept payment with Visa, Mastercard and Maestro debit & credit cards. We do not accept American Express cards.
  11. IMPORT DUTY:
    11.1 
    If you order a Package for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.
    11.2 
    Please also note that you must comply with all applicable laws and regulations of the country for which the Packages are destined. We will not be liable for any breach by you of any such laws.
  12. WRITTEN COMMUNICATIONS:
    Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
  13. NOTICES:
    All notices given by you to us must be given to Grandstand Media Ltd at [Grandstand Media Ltd, Stoneleigh Park, Kenilworth, Warwickshire, CV8 2LZ] [or by emailing [press@hoys.co.uk]. We may give notice to you at either the e-mail or postal address you provide to us when placing an order, or in any of the ways specified in clause 11 above. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.
  14. TRANSFER OF RIGHTS AND OBLIGATIONS:
    14.1 The contract between you and us is binding on you and us and on our respective successors and assigns.
    14.2 
    You may not transfer, assign, charge or otherwise dispose of the Contract, or any of your rights or obligations arising under it, without our prior written consent.
    14.3 We may transfer, assign, charge, sub-contract or otherwise dispose of the Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.
  15. EVENTS OUTSIDE OUR CONTROL:
    15.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (a “Force Majeure Event”).
    15.2 A Force Majeure Event includes any act, event, nonhappening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following: (a) strikes, lock-outs or other industrial action; (b) civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war; (c) fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster; (d) impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport; (e) impossibility of the use of public or private telecommunications networks; (f) the acts, decrees, legislation, regulations or restrictions of any government.
    15.3 Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
  16. WAIVER:
    16.1 If we fail, at any time during the term of a Contract, to insist upon strict performance of any of your obligations under the Contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.
    16.2 
    A waiver by us of any default shall not constitute a waiver of any subsequent default.
    16.3 
    No waiver by us of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with clause 14 above.
  17. SEVERABILITY:
    If any of these terms and conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
  18. ENTIRE AGREEMENT:
    18.1 
    These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.
    18.2 
    We each acknowledge that, in entering into a Contract, neither of us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us prior to such Contract except as expressly stated in these terms and conditions.
    18.3 
    We intend to rely upon these terms and conditions and any document expressly referred to in them in relation to the subject matter of any Contract. While we accept responsibility for statements and representations made by our duly authorised agents, please make sure you ask for any variations from these terms and conditions to be confirmed in writing.
  19. OUR RIGHT TO VARY THESE TERMS AND CONDITIONS:
    19.1 
    We have the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities.
    19.2 
    You will be subject to the policies and terms and conditions in force at the time that you order Packages from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the Dispatch Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the Packages).
  20. LAW AND JURISDICTION:
    Contracts for the purchase of Products detailed on our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
  21. PERSONAL INFORMATION:
    Where you have provided us with personal information, you consent to our use of this to (without limitation): update and enhance customer records, carry out identity verification, credit or anti-fraud checks against your name using third party databases (which may involve disclosure to registered credit reference or fraud prevention agencies who may retain and use your personal information), carry out analysis and to help us manage our business, statutory returns and legal and regulatory compliance.

General Competition Terms and Conditions

The following words and terms, when used within these rules, shall have the following meanings, unless the context clearly indicates otherwise;

Grandstand Media Ltd (The Promoter) – a company registered in England and Wales, whose registered office is Grandstand Media, Stoneleigh Park, Kenilworth, Warwickshire, CV8 2LZ, company number 2889798.

Horse of the Year Show – an event organised by Grandstand Media Ltd which takes place from 9th – 13th October 2024.

Prize – a prize won by the recipient who has won the competition

  1. These terms and conditions are the Competition Rules (‘’Rules’’) and apply to competitions ran by Horse of the Year Show unless otherwise stated. By entering a Competition, entrants agree to be bound by these rules.
  2. All entries must be received by the deadline stated on the competition.
  3. The Competition is organised by Grandstand Media Ltd of Stoneleigh Park, Kenilworth, Warwickshire, CV8 2LZ.
  4. The winner will be chosen from all correct entries unless otherwise stated. The decision of the judge and Grandstand Media Ltd shall be final and no correspondence or discussion shall be entered into.
  5. No cash alternative is available for any competition prize. All submitted entries/images give permission to be used on all HOYS promotional material, website and social media.
  6. The winner agrees to their name being announced and submissions posted on HOYS Official social media channels, including but not limited to; Facebook, Twitter, Instagram and YouTube.
  7. By entering the promotion the entrant agrees to take part in any publicity arising from the Promotion and authorises the Promoter’s inclusion in any third party publicity.
  8. Grandstand Media Ltd reserve the right to cancel or amend the Competition or Rules without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside Grandstand’s reasonable control. Any changes will be posted within these terms and conditions.   9. In the event of any dispute regarding the Rules, conduct, results and all other matters relating to a Competition, the decision of Grandstand Media Ltd shall be final and no correspondence or discussion shall be entered into.
  10. Competitions are not open to employees of Grandstand Media Ltd, their families, agencies, individual or otherwise any other company associated with the specific Competition.
  11. By entering a Competition, you hereby warrant that all information submitted by you is true, current and complete. Grandstand reserves the right to verify the eligibility of all entrants.
  12. Grandstand reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of the Rules.
  13. Grandstand Media Ltd reserves the right to substitute prizes of equal or greater value at any time.
  14. All entrants under the age of 18 must have the permission of a parent/guardian. Competitions are open to UK residents only.
  15. Your Entry and any information submitted by you must be personal to and relate specifically to you.
  16. All entrants must have permission to use their submitted image/intellectual property and give permission for the image/intellectual property to be used on the Official HOYS social media channels, including but not limited to; Facebook, X, Instagram and YouTube.
  17. Grandstand Media Ltd cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the Competition or as a result of accepting any prize.
  18. Any personal data relating to entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to a third party without the individual’s prior consent. Data relating to entrants will be retained by Grandstand Media Ltd for a reasonable period after the Competition closes to assist Grandstand Media Ltd to operate competitions in a consistent manner and to deal with any queries on the Competition.

Tradestand social media competitions

  • Anyone taking part in the competitions will be bound by the terms & conditions of the tradestand exhibitor hosting the competition.
  • Tradestand exhibitors at Horse of the Year Show have the opportunity to take part in the tradestand social media competition.
  • It is the responsibility of the tradestand exhibitor to notify Grandstand Media Ltd that they wish to take part and to send proof of the competition to the tradestand team via email to tradestands@hoys.co.uk
  • It is the tradestand exhibitor’s responsibility to conduct the competition, select the winner and to send out the winning tickets to the winner.
  • Grandstand Media will take no responsibility for any tickets which are not delivered by the tradestand exhibitor to the competition winner, do not arrive, are damaged, defaced or illegible.
  • Tickets showing any sign of being tampered with, or are illegible, damaged or defaced will be void. Photocopies will not be accepted. Tickets cannot be transferred, auctioned, sold or traded, and will be deemed void.
  • Tradestand exhibitors must run their competition prior to September 2024.
  • All of Grandstand Media’s General Competition Terms & Conditions apply.

Qualifying Stories

  • The qualifying stories competition is open to any competitor who has qualified to compete at Horse of the Year Show for that given year and in any discipline which is held at the Show.
  • The qualifying story must be submitted via the HOYS website or via email to press@hoys.co.uk
  • Once the story has been submitted, it will be reviewed by the HOYS Press team and then made available on the website for people to vote.
  • Entrants can be of any age, however, if they are under the age of 16 then they must supply consent from their parent or parental guardian in order for their story and image to be published and for the entry to be valid.
  • Prize for 2024 will be confirmed once the competition has opened for 2024.
  • The winner will be determined by the story which has received the most votes made by the public.
  • At no point can the prize be exchanged for an alternative prize or cash alternative.
  • The number of votes will kept at the discretion of Grandstand Media Ltd.
  • Grandstand Media Ltd reserve the right to remove any stories which they deem unsuitable for use.
  • Grandstand Media Ltd reserves the right to verify the eligibility of entrants and may require such information as it considers reasonably necessary for this purpose and a prize may be withheld unless and until Grandstand Media Limited is satisfied with the verification.
  • All images which are submitted with the qualifying story will need to be accompanied with the correct copyright information with appropriate permission for use.
 
 
 

HOYS Awards Terms & Conditions

  1. Details of parties involved

1.1 Promoter details: The promoter of these awards is Grandstand Media Ltd, a company registered in England with the company registration number 288 9798 with a registered office at Stoneleigh Park, Kenilworth, Warwickshire, CV8 2LZ. Grandstand Media Ltd is the organiser of Horse of the Year Show (“HOYS”).

1.2 Eligible participants: All horses and ponies entering all HOYS showing qualifiers, with the exception of Shire In-Hand horses, Ridden Heavy Horses (Leading Sire and Leading Breeder), Harness animals and Supreme In-Hand animals, will be eligible for the awards and are hereafter referred to as “HORSES” and “PONIES”. Sires of HORSES and PONIES competing in HOYS qualifiers will hereafter be referred to as “SIRES” and breeders of HORSES and PONIES competing in HOYS qualifiers will hereafter be referred to as “BREEDERS”.

1.3 Sponsors: The Leading Breeder Awards and The Leading Sire Awards will be sponsored by Richard and Lisha Leeman of the Kellythorpe Stud (“KELLYTHORPES”) and named Kellythorpes Leading Breeder Award and Kellythorpes Leading Sire Award respectively.

1.4 Data collection system: Data used to determine the award winners will be collected and recorded using the Grandstand Entries Show System (“GSS”).

  1. Conditions of entry

2.1 These awards are open to all HORSES and PONIES entering HOYS showing qualifiers, their SIRES and their BREEDERS, excluding Shire In-Hand horses, Ridden Heavy Horses (Leading Sire and Leading Breeder), Harness animals and Supreme In-Hand entries. Information on the qualifier placings of all entered animals will be recorded for these awards.

2.2 It is the responsibility of HORSE and PONY owners/exhibitors to ensure their animals and their details are correctly registered and recorded on the GSS.

2.3 By accepting any of these awards, the owner, exhibitor and breeder of any winning animal or any winning animals’ sire agree to be involved in any present or future promotion of these awards or any marketing activity relating to them, including, but not limited to the activity of Grandstand Media Ltd, HOYS, and KELLYTHORPES.

2.4 Please refer to each award section below for terms and conditions specific to each award.

3.  Kellythorpe’s Leading Breeder Awards & Kellythorpe’s Leading Sire Awards

3.1 The breeders of animals entered in all HOYS qualifiers are eligible for the Kellythorpe’s Leading Breeder Awards & Kellythorpe’s Leading Sire Awards, with the exception of Shire In-Hand horses, Ridden Heavy Horses, Harness animals and Supreme In-Hand entrants.

3.2 Awards will be given for the top BREEDER and top SIRE of each of the 12 British native breeds, plus hunters, show horses, coloureds, hunter ponies, show ponies, Arabs and Miniatures as detailed below:

3.3.2 These points will then be placed into a league table for each of the categories detailed.

3.3.3 Points will be tabulated against breeders’ names and or prefixes, and sires names and or prefixes. A breeder/sire may have more than one animal contributing towards their total points accumulation.

3.3.4 Points awarded at HOYS qualifiers will be awarded for placings in that qualifier only. Points will not be awarded based on the highest placed breeder of a particular breed or type in any section.

3.4 The winner of each of the 19 awards will be the breeder/sire who has accrued the most points in each category after all qualifiers have been completed in any one year.

3.5 There will be an award for the overall leading breeder and for the overall leading sire, which will be the breeder/sire who has accrued the greatest number of points across all HOYS qualifiers, excluding the British Ridden Heavy Horse, Shire In-Hand horses, Harness animals and Supreme In-Hand entrants qualifiers detailed in 5.1 and 5.2. This means that the overall breeder/sire may or may not be the same as one of the 19 category winners. Each of the 19 winning BREEDERS/SIRES will be presented with a certificate of their achievement.

3.6 It is the responsibility of breeders/owners of the sires to advise Grandstand Media Ltd by email (awards@grandstand.co.uk) if they use/have registered more than one prefix. Grandstand Media Ltd will not accept responsibility for any inaccuracies in calculating the overall leading breeder/leading sire title where this information has not been received and acknowledged.

3.7 The top BREEDER and the owner of the top SIRE from each of the 19 sections detailed in 5.2, plus one guest each, will be invited to a reception held at HOYS on Thursday 10th October 2024. The winners will receive prizes and certificates at this reception. If any winner or runner-up is not able to attend, they may appoint a representative. This representative must be made known to Grandstand Media Ltd by 1st October 2024. The overall Breeder and the overall Sire awards will be presented in the Andrews Bowen International Arena on Friday 11th October 2024.

3.8 All KELLYTHORPES LEADING BREEDER AWARDS and KELLYTHORPES LEADING SIRE AWARDS prizes and rewards are not transferable. There is no cash alternative to these prizes or rewards.

4.1 Grandstand Media Ltd shall not publish the final league tables until after the collection of data from all HOYS qualifying competitions has been completed.

5.1 All competitors, animals, exhibitors, owners and breeders must abide by the rules of HOYS qualifiers

5.2 Grandstand Media Ltd will not be held responsible for any loss, damage, injury or death incurred by any parties involved in these awards, their presentation or promotion.

5.3 Grandstand Media Ltd will not be held responsible and shall not be liable for any problems related to computer systems, equipment or online systems. This includes, but is not limited to, entries and results systems used by shows and/or their officials and secretaries.

5.4 Grandstand Media Ltd reserves the right to alter these terms & conditions at any time. It shall not be the responsibility of Grandstand Media Ltd to inform any parties about these changes. A copy of the most up-to-date terms and conditions will be displayed on the www.hoys.co.uk website at all times during the HOYS qualifying season.

5.5 Grandstand Media Ltd reserves the right to disqualify any person, partnership, company or other bodies if these terms & conditions are breached.

5.6 These terms and conditions shall be governed by the laws of England and Wales and any dispute (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English courts.
